Congratulations to a Knox Defense Attorney for winning a Motion to Vacate a Federal Sentence for his client, Charles Burton. The District Court agreed with a Knox Defense Attorney that the US Supreme Court’s decision in Johnson v. United States means that applying that case to Mr. Burton, his sentence should be vacated and he is entitled to be re-sentenced. The parties will file briefs, and then the judge will arrive at what he believes to be an appropriate new sentence. It appears that this opinion will reduce Mr. Burton’s lengthy sentences for pharmacy robbery, controlled substance sales, and possession of a fire arm by at least 136 months.
